CLUB RULES

The Club means Balance Health Nottingham.

The Managing Director or Manager means the Manager of the Club.

User or Member means any person using the Club or its facilities whether any charge has been paid and includes spectators or café users.

Questions arising as to the interpretation of these rules shall be determined by the Managing Director or other senior persons within Balance Health Nottingham whose decision shall be final.

 

The Club will not tolerate any abuse of staff by any member of the public whether a paid-up member or visitor. Any abusive language or physical assault could result in the police being informed and on request from any law enforcement agency CCTV footage may be shared to identify untoward behaviours and may be used as evidence.

CCTV coverage is recording throughout the internal and external areas of the Club for the purpose of protecting property and users and the detection and prevention criminal activity.

 The Club reserves the right to make reasonable changes to these Rules at any time. If changes are made, all members will be informed.

 

Membership

  1. To become a member, you will be required to provide the necessary personal details like your name, address, date of birth, telephone number, email address, photo and your bank or card details for monthly payments.

  2. Your personal details are stored within our management system, Xplor GYM (www.xplorgym.co.uk) and are not accessible by anybody other the those allowed access to fulfil the necessary role in maintaining your membership.

  3. At all times we ensure we have the correct organisational, technical and security means in place to protect your personal data.

  4. We operate a direct debit for all monthly memberships.

  5. Your membership is only valid at Balance Health Nottingham.

  6. Your membership commences from the date of purchase.

  7. We have the right to refuse your application for membership.

  8. If we cease to operate the Club due to its sale or transfer, your Membership of the Club will (unless otherwise notified to you) continue to be valid.

  9. Please inform the Club in writing of any changes in your name, address, telephone number, email address. You can visit your online member portal where you can update the personal details directly yourself.

  10. We may terminate your membership in the following situations and with the following notice periods:

    • without notice if you repeatedly or seriously break the Club Rules;

    • without notice for any threatening behaviour to either staff or other members of the club;

    • without notice for any events of fraud or deception;

    • with notice if you failed to update a payment agreement to continue your membership which will be 30 days’ notice

  11. No refunds on upfront/cash memberships such as annual memberships.

  12. Three inductions are available.

  13. A site health and safety induction is compulsory and must be booked prior to attending the Club.

  14. A gym/ equipment orientation can be provided on request by a member of staff.

  15. An advanced induction and programme with a member of the fitness team maybe chargeable.

 

Guest Pass

If the Club decides to offer Guest Passes, the following rules apply. A Guest Pass is a good idea if you’re visiting for the day, if you want a friend to join you along the way, or if you’re curious to see what it’s like to use our facility.

  1. A Guest Pass gives access to the Club.

  2. The Club reserves the right to determine how long a Guest Pass is permitted for use and any expiry date is at the sole discretion of the Club.

  3. You must abide by all rules and failure to abide by the rules your Guest Pass will be terminated.

  4. The Guest Pass allows access to the fitness suite and a fitness class.

 

Promotional Membership Offer

  1. Following any promotional period, the membership fees will be frozen at this price until you are notified otherwise.

  2. If you fail a payment, freeze, or cancel your membership and wish to join again you will revert to paying the current full standard prices.

  3. Membership offers will be offered from time to time and will be subject to additional terms and conditions.

  4. All users redeeming the offer are bound by the membership terms and conditions.

  5. All users redeeming the offer will be required to complete a health declaration  and participate in a Club induction.

  6. Management has the final decision in all matters relating to this offer and their decision is final and binding.

  7. Management has the right to remove, amend or extend this offer at any time.

  8. No refunds are available once contracts have been signed.

  9. Any direct debit discounted membership offer will remain valid unless you cancel, freeze, or miss direct debit payments. If any of those three apply, then we have the right that your membership reverts to the normal monthly applicable fee amount.

  10. There is no cash alternative to this offer.

 

Admission and fees

  1. On joining Balance Health Nottingham, you will pay an INITIAL PAYMENT – this is what you will pay today, which will consist of a joining fee, a pro rata fee which is to cover from the start date of your membership to the first date your recurring monthly direct debit.

  2. The Club reserves the right to waive the joining fee.

  3. For all information on memberships please visit www.balancenottingham.co.uk or the main reception of the Club.

  4. Those admitted to the Club are only admitted on the basis they will observe these rules.

  5. There is no re-admission without the required payment. All fees must be paid prior to commencing use of the facility.

  6. All persons entering the Club must have an active membership.

  7. All Guest Pass membership wristbands (if issued) must be retained, produced, or surrendered by the Manager or supervisor on demand.

  8. Any complimentary tickets issued by the Club, are issued without prejudice and the issue of such tickets does not represent an admission of liability.

  9. For the safety and enjoyment for the members, the management reserves the right to refuse admission or to remove from the Club any user without stating any reason and a user shall at any time comply with all reasonable instructions and requests of the manager to carry out and observe all instructions relating to the use of the Club and conduct therein which may from time to time be published by notice on the premises or otherwise.

  10. All members must always use their own membership wristband or QR code via the app within the Club and swipe it to validate their visit/participation in each activity.

  11. It is a member’s responsibility to keep safe their membership wristband. Should it be lost, stolen or misplaced the member must purchase a replacement from the main reception at a fee of £10.00.

  12. No member will be allowed admittance into the Club without a valid membership wristband.

  13. If a user is found to be misusing a wristband not belonging to them, then the member who owns the wristband must pay £10 for return of their wristband.

 

Pausing Gym Membership

  1. If you are unable to use the Club facilities for any reason you may pause your Membership.

  2. You must however have completed three full months as a member to qualify for the pause.

  3. You may pause for a minimum of one month to a maximum of three months within any period of 12 consecutive months.

  4. Two weeks’ notice prior to your next direct debit date is required.

  5. The cost is £10 per month for this service.

  6. At the discretion of the Management, we may allow you to pause your membership based on a medical need like during pregnancy, injury to a limb, heart condition etc. we may require written evidence from your medical practitioner on this matter.

 

Health and Safety

  1. All management on duty are responsible for the safety of users and their instructions must be always followed at all times.

  2. All personal property is a user’s responsibility and must be safely stored and locked in the lockers provided. Strictly no personal property is allowed unattended in changing rooms or in the gyms.

  3. In the event of a fire, the fire alarm will  sound which is a continuous alarm  If activated, all users of the Club must leave the building and following the instruction of the staff on duty.

  4. The management reserves the right to hold practice alarm drills from time to time to test the procedure for clearing the Club in case of emergency.

  5. All accidents must be reported to the manager on shift immediately and an accident form completed.

  6. If your circumstances change at any time; that may inadvertently affect your safety when using the facilities, please let a member of staff know immediately.

  7. For your safety some facilities and activities within the Club operate age restrictions.

  8. No users under the age of 18 allowed to use the fitness facilities.

 

Facilities and services

  1. Balance Health Nottingham reserves the right to alter, amend or cancel admission charges, availability of facilities, access to facilities, timing of activities and classes at any time and without notice.

  2. All users are requested to vacate all facilities when a period for which they booked has expired as they may delay other users who have paid for the next booking.

  3. All users must respect all equipment, facilities, furniture, fittings, apparatus and always building infrastructure. A user shall pay to the Club on demand the cost of any damage caused. The Manager’s decision is final.

  4. Users should observe single sex change and toilet facilities always using this appropriate to their gender.

  5. Disabled facilities have been provided for strict use only by the disabled user and their carer and family.

  6. The Club membership purchased allows unlimited access to the fitness suites. As part of this membership the users will be allowed free access to the classes available.

  7. The number of free classes to full memberships may increase or decrease periodically at the discretion of the Management.

  8. Reformer is not included in the Club membership fee. However, Reformer specific memberships are available.

  9. Dedicated Programs are also chargeable and are available to book via the website.

Gym/ fitness facilities

  1. Only adults aged 18 years or over are permitted to use the gym.

  2. All gym users must complete a medical questionnaire and participate in an induction.

  3. Equipment will only work with a valid membership wristband. 

  4. Please wipe down the kit after use with the tissue provided by the site. Please ensure all equipment is returned safely to its original location.

  5. We respectfully ask users to wear clean sports kit and appropriate footwear; please refrain from using outdoor footwear in the gym.

  6. Users are advised to alert gym staff if they have any medical conditions that may affect your ability to exercise or if your health changes throughout your membership at the Club.

  7. The user must report on first noticing any fitness equipment which is faulty or damaged.

 

Classes

  1. Users/ members of classes must wait outside the studio until invited in by the instructor and be available 5 minutes before the class commences.

  2. The class instructor reserves the right to decline entry to anyone who is not on time. 

  3. All classes must be pre-booked via our online booking system or via the main reception.

  4. We aim to provide a balanced and varied programme of classes each week subject to availability and viability.

  5. Please note classes may be cancelled or suspended without notice at Management’s discretion.

  6. For smooth running of the classes, we operate a system whereby 3 classes that are not attended then the member will not be able to book another class for 10 days.

 

General

  1. For your security, we have an access control system in place where all users of the fitness suite must swipe to gain entry.

  2. We have CCTV installed throughout the gym floor which records and is monitored for the security and prevention of crime.

  3. All users must respect each other when using the facilities foul and abusive language and anti-social behaviour will not be tolerated. Users who disregard the above and affect the Club’s enjoyment by others will be removed from the Club immediately.

  4. We offer locker facilities for all belongings to be left during a members visit to our gym; we do not allow any bags to be left or carried on to the gym floor to avoid any hazards.

  5. Users wishing to make a complaint or a useful suggestion to the operational best practice of the Club must complete a customer feedback form located at the main reception. All formal complaints must be made directly to the Manager in writing.

  6. Photographs for professional use and publication thereof must not be taken without the prior written consent of the manager.

  7. Users are not permitted to bring their own refreshments into the Club. Strictly no refreshments to be taken in the changing areas.

  8. The Manager reserves the right to dispose of any item of non valuable lost property not claimed after two weeks. Valuable lost property will be considered for disposal after 1 month.

  9. Appropriate clothing must be always worn, relating to the activity/ facility you are participating in.

  10. No user shall reward a teacher, instructor, or staff member personally without prior consent of the Manager.

  11. The Club has a strict no smoking policy.

  12. No animals are allowed in the Club apart from dogs assisting the disabled.

  13. We reserve the right to refuse admission or ask you to leave the Club if we reasonably believe you or your guest is in breach of any section of these rules.

  14. The decision of the Manager on every occasion is final.
